TERMS OF SERVICE
General Provisions
Xleap Care Private Limited (hereinafter "Flawsome"), a Company incorporated under the provisions of the Companies Act, 2013 and having its registered office at Flat No. 3, Vasant Apartment, Mayur Vihar, East Delhi, New Delhi, India - 110091 offers its products for sale directly to its customers through this website https://myflawsome.com/ (hereinafter “Site”). The sale of Products on the Site is subject to these Terms and Conditions of Sale (hereinafter "Terms of Sale").
Information for Consumers
1. The Products displayed on the Site are offered for sale to consumers only (hereinafter “Consumer(s)” or "You"). The purchase of the Products on the Site is permitted only to individuals who are 16 years of age or over. The Products offered for sale on the Site can be purchased and shipped only to the locations/pin codes indicated on the Site.
2. Before confirming and submitting a purchase order, You must carefully read and accept these Terms of Sale. These Terms of Sale can be downloaded from the Site and/or requested via e-mail:ranukhade@myflawsome.com. Flawsome will send them to You pursuant to Article 3 below. We recommend that You print or electronically store a copy of the Terms of Sale, together with a copy of the Privacy Policy, for Your future reference. These Terms of Sale, together with the Privacy Policy, contain the rules governing the contract between You and Flawsome for the purchase of Products through the Site.
3. By submitting a purchase order, You hereby accept and undertake to observe, in the performance of the contract with Flawsome, these Terms of Sale. If You do not agree with any of the terms set out in the Terms of Sale, You shall not submit the purchase order for the purchase of the Products on the Site.
Order Procedure and Acceptance
1. For each Product offered for sale on the Site, a picture of the Product will be displayed, together with the unit price, the colours, and sizes available. Pictures are provided purely to illustrate the Product. Flawsome will not be responsible for any inadequate graphical representation of the Products offered.
2. To purchase a Product, You shall select the Product(s), the colour and the size. The selected Product(s) will be added to Your shopping bag. It will not be possible to save the shopping bag to proceed at a later stage. If the purchase procedure is not completed, all items in the cart will be deleted and You will need to start a new purchase procedure. The sales procedure is considered concluded only when the payment information has been confirmed. To submit the order, You will be required to provide personal data, including date of birth, payment details, and accept these Terms of Sale. You are invited to carefully review the summary of the essential characteristics of each Product ordered, the shipping costs, the conditions to exercise Your right of withdrawal, and the Privacy Policy.
3. It is possible to correct errors in the purchase process until submission of the order by following the Amendment Procedure indicated on the Site. Once the order is submitted, You will not be able to amend or cancel it.
4. After submission, Flawsome will send You an email confirming receipt of the order and its processing (the "Acknowledgement Receipt"). Consumer orders will be stored in Flawsome’s database located in Gurgaon for the necessary time. Please note that the Acknowledgement Receipt does not constitute acceptance of Your order. The order will be accepted and Your card debited only after the Products are ordered. At this point, Flawsome will send an "Order Confirmation". A paper invoice will be included with the delivered Product.
Flawsome reserves the right to refuse orders at its sole discretion, including from individuals not meeting order requirements, having ongoing disputes, or appearing to be dealers/distributors.
Availability
1. You are invited to check Product availability before purchase as Products may be subject to stock limits and Flawsome does not guarantee constant availability.
2. In case of temporary unavailability, Flawsome will inform You within 5 working days. If payment has been charged, a refund will be issued within 30 days.
Prices and Payment
1. Prices are in Indian Rupees (INR). Flawsome is not responsible for any exchange rate discrepancies by Your bank.
2. While efforts are made to ensure price accuracy, errors may occur. If an error is discovered after the Acknowledgement Receipt but before Order Confirmation, Flawsome will ask You to re-confirm or cancel the order. If You cannot be contacted, the order will be cancelled and a cancellation email sent.
3. Prices include GST except during discount periods. Shipping costs and other taxes will be itemized at checkout and in the invoice.
4. Payments accepted: Visa, Maestro, MasterCard, and e-wallets.
5. Products will be shipped only after credit card verification or payment authorization.
6. Products are supplied with an identification card. Do not remove this until You verify

Delivery
1. Products are dispatched to the address provided during purchase. Orders will not be shipped to P.O. Boxes.
2. Deliveries are by selected couriers (e.g., DTDC, Safe Express), Monday to Friday excluding holidays.
3. Products will be delivered within 5 business days in metropolitan cities and within 10 business days in non-metropolitan areas. Flawsome is not responsible for courier delays.
4. If Products are not received within 10 business days, contact ranukhade@myflawsome.com. Complaints beyond 30 days from Order Confirmation will not be entertained.
Changes and Corrections
1. Flawsome reserves the right to modify Terms of Sale, Privacy Policy, Product details and pricing at any time without notice. Please check them before each purchase.
2. Efforts are made to ensure accurate Product information, but typographical errors may occur. Flawsome may correct errors, update information, revoke erroneous offers, or cancel orders prior to shipment.
3. If charged for a cancelled order, You will be informed and refunded within 30 days.
Changes apply only to subsequent orders unless otherwise decided by Flawsome.
Conformity of Orders
1. Products must be checked at delivery to ensure they correspond to the order.
2. Any anomalies identified at the time of delivery — including but not limited to tampering or damage to packaging, damaged products, missing items (as per the transport document), non-conformity with the products ordered, or defective items (hereinafter referred to as “Defects”) — must be reported directly to Flawsome by emailing ranukhade@myflawsome.com. In such cases, the consumer is not obligated to accept the delivery.
3. If any Defects are identified after delivery, the consumer may return the product to Flawsome by following the return procedure outlined in Section 10 below.
Right of Withdrawal
- Flawsome reserves the right to inspect returned products and reject any that do not meet the return requirements specified in Article 2 below under Legal Warranty for Non-Conforming Products .
- To return products to Flawsome, consumers must follow these steps:
2.1.1 Ensure the presence of product labels and commercial documents within the package.
2.1.2 Contact the courier using the number provided on the receipt and coordinate a date and time for pickup.
2.1.3 Request and retain a signed copy of the collection receipt from the courier as proof of return. In such cases, all shipping charges, including return costs, will be borne by Flawsome.
3. If the consumer chooses not to use the courier appointed by Flawsome, it is strongly recommended to insure the full value of the returned product and retain shipping receipts and tracking numbers. In this scenario, the consumer will bear the return shipping costs, and Flawsome will not be liable for any lost, stolen, or damaged products during return transit.
4. Products must be returned to the following address:

5. Products may be exchanged within 10 days from the date of receipt. No refunds are offered. Exchanges are only applicable in cases of manufacturing defects.
Legal Warranty for Non-Conforming Products
1. All Flawsome products sold on the site are covered by a 6-month legal warranty from the date of receipt. This warranty covers any defect or non-conformity. If a product is found to be defective or different from what was ordered, the consumer may request a replacement. If a replacement is not possible, the consumer is entitled to a full refund, including the original and return shipping costs. Refunds will be processed within 30 days of the returned item being received and verified.
2. To return a defective product:
2.1 Consumers must report any defect or non-conformity within 15 days of discovery (within the 6-month warranty period) by writing to ranukhade@myflawsome.com, clearly describing the defect and stating whether they seek a replacement or refund.
The defective product must be returned via courier to:

3. Flawsome recommends using insured shipping if the consumer does not use the company’s appointed courier.
4. If a courier other than Flawsome’s designated service is used, Flawsome will not be liable for any loss or damage during transit.
5. Flawsome reserves the right to inspect the returned product. If no defect or non-conformity is found, the product will be returned to the consumer.
Flawsome Liability

All products are sold “as available.” Apart from the legal warranty mentioned under Legal Warranty for Non-Conforming Products above, Flawsome does not provide any express or implied warranties beyond the product description

Flawsome is not liable for any damages — direct, indirect, incidental, or consequential — resulting from the use or inability to use the website, reliance on site information, service interruptions, data loss, software errors, delays, or unauthorized access to Flawsome’s systems or services.

Notwithstanding the above, Flawsome does not limit liability for fraud, death, personal injury caused by negligence, or any other liability that cannot be excluded under applicable consumer protection laws.

Your use of the website is subject to the Terms of Use, available for viewing and download on the site.

We commit to acknowledge your complaint within 48 hours and resolve it within 30 days from the receipt in accordance with applicable laws. You will receive the ticket number post acknowledgement of your complaint, and the ticket number can be used to track your complaint.
Governing Law & Jurisdiction
- Any dispute arising from these Terms of Sale or any purchase made from Flawsome shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
- If any provision in these Terms of Sale is deemed invalid or unenforceable, the remaining provisions shall continue to be fully effective.
